Terms & Conditions — Studio Cast Away

1. Services Offered

Studio Cast Away provides the following services:

• Podcast recording — audio only or audio & video sessions.
• Photography — in-studio photography sessions.
• Post-production — editing, mastering, and other after-edit services.

Details of current services and pricing are available on our homepage. We reserve the right to update or change our offerings at any time without prior notice.

2. Bookings & Payments

1. All bookings must be made in advance via our official booking system or by direct agreement with us.
2. A deposit or full payment may be required to confirm a booking.
3. Cancellations:
   • Up to 48 hours before the session — No cancellation fee, full refund or credit.
   • Less than 48 hours before the session — We reserve the right to retain the deposit or charge up to 50% of the booking fee.
4. No-show bookings will be charged in full.

3. Studio Usage

1. Clients are expected to use the studio and equipment carefully and according to instructions.
2. The Client is financially responsible for any damage to the studio, furniture, or equipment caused by misuse, negligence, or intentional actions by the Client or their guests.
3. Food and beverages are allowed only in designated areas and must not interfere with recording equipment or studio surfaces.
4. Smoking, vaping, or the use of illegal substances is strictly prohibited inside the studio.

4. Liability & Indemnification

1. No responsibility for content: Studio Cast Away assumes no liability for any content created, recorded, or distributed using our facilities, including any legal, financial, or reputational consequences thereof.
2. The Client is solely responsible for obtaining any necessary rights, licenses, or consents for the materials recorded or produced in the studio.
3. The Client agrees to indemnify and hold harmless Studio Cast Away, its owners, and staff from any claims, damages, or expenses arising from:
   • Content created or published by the Client.
   • Misuse of studio equipment or violation of these Terms.

5. Recording Delivery & Storage

1. We will deliver two versions of the recorded material:
   • Raw version — unedited source files.
   • Mastered version — edited and polished files, ready for release.
2. Files will be provided via digital download and will remain accessible for 7 days after the delivery notice.
3. It is the Client’s responsibility to download and securely store the files within the 7-day period.
4. Unless explicitly agreed upon and paid for, all source material will be permanently deleted after the download period has expired.
5. With the Client’s written consent, we may retain portions of recordings for Studio Cast Away’s own marketing purposes.

6. Confidentiality

We respect the confidentiality of our Clients’ recordings and project information. Recordings and related materials will not be shared with third parties without the Client’s consent, unless required by law.

7. Intellectual Property

1. All intellectual property rights in the recorded content remain with the Client, provided all fees have been paid in full.
2. Studio Cast Away retains the right to use excerpts for marketing purposes only with the Client’s prior written consent.

8. Technical Limitations & Interruptions

1. We make every effort to ensure a smooth and uninterrupted recording experience.
2. In the event of technical failure, power outage, equipment malfunction, or disturbance our liability is limited to:
   • Offering a re-recording session at no additional cost, or
   • Providing a partial refund of the booking fee.
3. Studio Cast Away is not responsible for consequential damages, lost income, or missed deadlines caused by such interruptions.

9. Behavior & Conduct

1. Clients and their guests must behave respectfully towards Studio staff and other users of the space.
2. We reserve the right to terminate a session immediately, without refund, if:
   • There is abusive, threatening, or unsafe behavior, or
   • Illegal activities are observed or suspected.

10. Insurance

Clients are responsible for arranging their own insurance for:

• Valuable personal equipment brought to the studio.
• Public liability coverage related to their production activities, if required.

11. Limitation of Liability

To the maximum extent permitted by law, Studio Cast Away shall not be liable for:

• Any indirect, incidental, or consequential damages,
• Loss of data or recordings,
• Delays caused by factors beyond our reasonable control.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of Portugal. Any disputes arising shall be resolved exclusively by the competent courts in Faro, Portugal.

13. Changes to Terms

Studio Cast Away reserves the right to update these Terms at any time. Updated versions will be posted on our website. Continued use of our services constitutes acceptance of the revised Terms.
